How We Collect and Use Information

We collect the following types of information about you:

Information you provide us directly:
We ask for certain information such as your username, real name, and email address when you register for a Business 4 Blessing Alliance (B4B) account, or if you correspond with us. If you register a business, we will ask for basic information about your business. If you register a personal profile we will ask information about your desires, history and location. We may also retain any messages you send through the B4B Website Service (Service), and may collect information you provide in User Content when you post to the Service. We use this information to operate, maintain, and provide to you the features and functionality of the Service. Your username will be published publicly. Once published your username may not be able to be removed.

Information from third parties:
We have chosen not to link or allow a user to log in via a thirdparty site such as Facebook, etc. While this may be an inconvenience to you, we want to provide the best possible protection for all our Users.

Inviting a friend to use B4B:

B4B may, by its sole discretion, develop a feature that allows you to invite third parties to the Service. If you choose to use our invitation service to invite a third party to the Service through our “Invite friends” feature, you may directly choose a friend to invite through your mobile device’s native contact list. However, we do not require that you import your contacts list to the Service, and we do not retain the information contained in your contacts list. You understand that by inviting a friend to B4B through the “Invite friends” feature, you are directly sending a text or email from your personal accounts and that we are not storing your contact list. In addition, you understand and agree that normal carrier charges apply to communications sent from your phone. Since this invitation is coming directly from your email or phone, we do not have access to or control this communication.

Analytics information:

We may directly collect analytics data, or use third-party analytics tools and services, to help us measure traffic and usage trends for the Service. These tools collect information sent by your browser or mobile device, including the pages you visit and other information that assists us in improving the Service. We collect and use this analytics information in aggregate form such that it cannot reasonably be manipulated to identify any particular individual user.

Cookies information:

Full details can be found on our Cookie Policy. When you visit the Service, we may send one or more cookies — a small text file containing a string of alphanumeric characters — to your computer that uniquely identifies your browser and lets B4B help you log in faster and enhance your navigation through the site. A cookie may also convey information to us about how you use the Service (e.g., the pages you view, the links you click and other actions you take on the Service), and allow us or our business partners to track your usage of the Service over time. A persistent cookie remains on your hard drive after you close your browser. Persistent cookies may be used by your browser on subsequent visits to the site. Persistent cookies can be removed by following your web browser’s directions. A session cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. Log file information:

Log file information is automatically reported by your browser or mobile device each time you access B4B. When you use our Service, our servers automatically record certain log file information. These server logs may include anonymous information such as your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Service, domain names, landing pages, pages viewed, and other information.

Clear gifs/web beacons information:

When you use the Service, we may employ clear gifs (also known as web beacons) which are used to anonymously track the online usage patterns of our Users. In addition, we may also use clear gifs in HTML-based emails sent to our users to track which emails are opened and which links are clicked by recipients. The information allows for more accurate reporting and improvement of B4B.

Device identifiers:

When you access B4B by or through a mobile device (including but not limited to smart-phones or tablets), we may access, collect, monitor and/or remotely store one or more “device identifiers,” such as a universally unique identifier (“UUID”). Device identifiers are small data files or similar data structures stored on or associated with your mobile device, which uniquely identify your mobile device. A device identifier may be data stored in connection with the device hardware, data stored in connection with the device’s operating system or other software, or data sent to the device by B4B. A device identifier may convey information to us about how you browse and use the Service. A device identifier may remain persistently on your device, to help you log in faster and enhance your navigation through the Service. Some features of the Service may not function properly if use or availability of device identifiers is impaired or disabled.

Location data:

When you access the Service by or through a mobile device, we may access, collect, monitor and/or remotely store “location data,” which may include GPS coordinates (e.g. latitude and/or longitude) or similar information regarding the location of your mobile device. Location data may convey to us information about how you browse and use the Service. Some features of the Service, particularly location-based services, may not function properly if use or availability of location data is impaired or disabled.

Commercial and marketing communications:

We use the information we collect or receive, such as your email address, to communicate directly with you. We may send you emails containing newsletters, promotions, and special offers. If you do not want to receive such email messages, you will be given the option to opt out or change your preferences. We also use your information to send you Service-related emails (e.g., account verification, purchase and billing confirmations and reminders, changes/updates to features of the Service, technical and security notices). You may not opt out of Service-related emails. You may also be able to be “found” on B4B based on information that you provide or your username.

Use of certain service type information we collect about you:

We use or may use cookies, log file, device identifiers, location data and clear gifs information to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the site; (b) provide custom, personalized content and information; (c) to provide and monitor the effectiveness of our Service; (d) monitor aggregate metrics such as total number of visitors, traffic, and demographic patterns; (e) diagnose or fix technology problems; (f) help you efficiently access your information after you sign in; (g) to provide advertising to your browser or device, and (h) automatically update the B4B application on your mobile devices.

Sharing of Your Information

We will not rent or sell your information to third parties outside B4B and its group companies (including any parent, subsidiaries and affiliates) without your consent, except as noted below:

  • Who we may share your information with: We may share your information with thirdparty business partners and Trusted Users for the purpose of providing the Service to you. Third party business partners will be given limited access to your information as is reasonably necessary to deliver the Service, and we will require that such third parties comply with this Privacy Policy, or operate under a similar privacy policy.
  • Who can see User Content: Any User Content that you voluntarily disclose for posting to the Service becomes available to the public and cannot be removed, except by the Service by its sole discretion. Once posted on B4B, User Content may not be removable from public view, as copies may remain viewable in cached and archived pages of the Service, on other sites that have republished us, or if other Users have copied or saved that information. If you do not wish your User Content to be available to the public, please don’t post it on B4B. Your username will be published publicly. Once published your username may not be able to be removed.
  • Who can see your IP address: If you post User Content on the Service while not logged in, your IP address will be published with your User Content in order to attribute your contribution to the Service. A selection of Trusted Users with administrative powers on B4B have the ability to review IP addresses of users to reduce abusive behavior. Any third party service embedded on B4B such as an advertiser, video provider, social network or other third party will also have access to your IP address.
  • Who can see your email address: If you enter an email address, you will enable communication from B4B. If you reply to users or participate in group B4B activities such as webinars, your email address will be shared with these Users.

What happens in the event of a change of control:

We may buy or sell/divest/transfer the company (including any shares in the company), or any combination of its products, services, assets and/or businesses. Your information such as customer names and email addresses, User Content, and other user information related to the Service may be among the items sold or otherwise transferred in these types of transactions. We may also sell, assign or otherwise transfer such information in the course of corporate divestitures, mergers, acquisitions, bankruptcies, dissolutions, reorganizations, liquidations, and/or similar transactions or proceedings involving all or a portion of the company.

Instances where we are required to share your information:

B4B will disclose your information where required to do so by law or subpoena or if we reasonably believe that such action is necessary to (a) comply with the law and the reasonable requests of law enforcement; (b) to enforce our Terms of Use or to protect the security, quality or integrity of our Service; and/or (c) to exercise or protect the rights, property, or personal safety of B4B, our Users, or others.

Sharing certain service type information we collect about you:

We may share certain service type information, including information obtained through tools such as cookies, log files, device identifiers, location data and clear gifs (such as anonymous usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with our thirdparty business partners for the purposes described in the section above on “How We Collect and Use Information.”

Ads on B4B:

The ads on B4B are all from member businesses that value the principles of a B4B business and have joined B4B as a business. We place the ads and when you click on that ad, you will be directed off the B4B website to the advertiser’s website. We will track the “clicks” to understand how many people click through to our advertisers so that we can set our advertising rates. Our B4B member advertisers may use technologies (such as cookies, JavaScript, device identifiers, location data, and clear gifs, see above) to compile information about your browser’s or device’s visits and usage patterns on the Service and on other websites, and to measure the effectiveness of their ads.

For example, Google uses DART cookies in order to deliver ads. Google's use of the DART cookie enables it and its partners to serve ads to you based on your visit to a company’s website and previous websites that you may have visited. Other advertising networks also use similar cookies, clear gifs, or other mechanisms to deliver targeted advertising to you. When you click on a B4B member company’s URL, they may have software to track your website history. You can delete these cookies by following the instructions on your browser or setting certain limitations on sharing your data. You may opt out of use of Google’s DART cookie and cookies placed by Network Advertising Initiative (NAI) certified ad networks here: http://www.networkadvertising.org/managing/opt_out.asp . Opting out of these cookies will be effective on all websites with NAI certified advertising networks. However, these opt-outs will be ineffective on networks that are not NAI certified.

Please note that an advertiser may ask B4B to show an ad to a certain audience of Users (e.g., based on demographics or other interests). In that situation, B4B or our Partners determines the target audience and B4B serves the advertising to that audience and only provides anonymous data to the advertiser. If you respond to such an ad, the advertiser or ad server may conclude that you fit the description of the audience they are trying to reach.

The B4B Privacy Policy does not apply to, and we cannot control, the activities of thirdparties. Please consult the respective privacy policies of such third parties or contact such third parties for more information.

How We Store and Protect Your Information

Storage and Processing:
B4B is hosted in the United States by www. ixwebhosting.com. We have carefully chosen this hosting service because of their careful monitoring of security. We have protected the Service with SiteLock security and a domain validated, 2048 bit industry standard SSL Certificate.

When you purchase a service or product on the Service, you are required to go through PayPal. All payments are handled through industry trusted PayPal. You will be required to have a PayPal account, but can use any of their accepted credit cards. Your agreement with PayPal is completely separate from your agreement with B4B.

Your information collected through the Service may be stored and processed in the United States or any other country in which B4B or its subsidiaries, affiliates, or service providers maintain facilities. B4B may transfer information that we collect about you, including personal information, to affiliated entities, or to other third parties across borders and from your country or jurisdiction to other countries or jurisdictions around the world. If you are located in the European Union or other region with laws governing data collection and use that may differ from U.S. law, please note that we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as yours. You consent to the transfer of information to the U.S. or any other country in which B4B or its parent, subsidiaries, affiliates, or service providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy.

Keeping your information safe:

B4B cares about the security of your information, and uses commercially reasonable safeguards to preserve the integrity and security of all information collected through the Service. To protect your privacy and security, we take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your account. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to your email communications from B4B at all times. However, B4B cannot ensure or warrant the security of any information you transmit to B4B or guarantee that information on the Service will not be accessed, disclosed, altered, or destroyed. B4B is not responsible for the functionality or security measures of any third party.

Compromise of information:

In the event that any information under our control is compromised as a result of a breach of security, B4B will take reasonable steps to investigate the situation and, where appropriate, notify those individuals whose information may have been compromised and take further steps, in accordance with any applicable laws and regulations.

Your Choices about Your Information

You control your account information and settings. You may update your account information and email-communication preferences at any time by logging in to your account and changing your profile settings. You can also stop receiving promotional email communications from us by modifying your preferences in "My Profile" under "User Preferences."

We make every effort to promptly process all unsubscribe requests. As noted above, you may not opt out of Service-related communications (e.g., account verification, purchase and billing confirmations and reminders, changes/updates to features of the Service, technical and security notices). Opting out of collection of your information for Tracking / Advertising:

Please refer to your mobile device or browser’s technical information for instructions on how to delete and disable cookies and other tracking/recording tools. Depending on your type of device, it may not be possible to delete or disable tracking mechanisms. Note that disabling cookies and/or other tracking tools prevents B4B or its business partners from tracking your browser’s activities in relation to the Service, and for use in targeted advertising activities by third parties. However, doing so may disable many of the features available through the Service. How long we keep your private profile information:

Following termination of your User account, B4B may retain your private profile information for a commercially reasonable time for backup, archival, or audit purposes. Any information that you choose to make public on the Service may not be removable.

Children’s Privacy

B4B does not knowingly collect or solicit any information from anyone under the age of 13 or knowingly allow such persons to register as Users. The Service and its content are not directed at children under the age of 13. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. Links to Other Websites and Services:

We are not responsible for the practices employed by websites or services linked to or from the Service, including the information or content contained therein. Please remember that when you use a link to go from the Service to another website, our Privacy Policy does not apply to thirdparty websites or services. Your browsing and interaction on any thirdparty website or service, including those that have a link or advertisement on our website, are subject to that third party’s own rules and policies. In addition, you agree that we are not responsible for and do not have control over any thirdparties that you authorize to access your User Content. This Privacy Policy does not apply to information we collect by other means (including offline) or from other sources other than through the Service.

  1. Read our values as we expect that each person and business agrees and understands that biblical values are the foundation of the Business 4 Blessing Alliance (B4B) which you are joining.

Introduction

Welcome to Business 4 Blessing Alliance, the website, mobile and online service of Business 4 Blessing Alliance, Inc. (“B4B,” “we,” or “us”). This page explains the terms by which you may use our online and/or mobile services, website, and software provided on or in connection with the service (collectively the “Service”). By accessing or using the Service, you signify that you have read, understood, and agree to be bound by this Terms of Use Agreement (“Agreement”) and to the collection and use of your information as set forth in the B4B Privacy Policy , whether or not you are a registered user of our Service. This Agreement applies to all visitors, users, and others who access the Service (“Users”).


PLEASE READ THIS AGREEMENT CAREFULLY TO ENSURE THAT YOU UNDERSTAND EACH PROVISION. THIS AGREEMENT CONTAINS A MANDATORY ARBITRATION OF DISPUTES PROVISION THAT REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS.

Use of Our Service

B4B provides a place for Users to connect and to share knowledge and ideas with others. Our goal as God’s faithful followers, is to enable the establishment of successful businesses around the world by connecting people, encouraging creativity, developing resources, and increasing knowledge and skills, thus fulfilling His mandate. We appreciate your valuable contributions to the Service.

A. Eligibility
You may use the Service only if you can form a binding contract with B4B, and only in compliance with this Agreement and all applicable local, state, national, and international laws, rules and regulations. Any use of the Service by anyone under 13 is strictly prohibited and in violation of this Agreement. Notwithstanding the foregoing, a child under the age of 13 may use the site if we receive a signed permission form from the child’s parent or legal guardian.

B. B4B Service
Subject to the terms and conditions of this Agreement, you are hereby granted a non-exclusive, limited, non-transferable, freely revocable license to use the Service as permitted by the features of the Service. B4B may terminate this license at any time for any reason or no reason. Subject to the terms and conditions hereof, B4B further grants to each User of the Service, a license to use any or all text contained in any article found on the Service for their own personal non-commercial use. Under this license, you may freely use and copy such text for non-commercial personal use. Any additional use requires express written permission. Such written permission may be granted on a case by case basis with attribution requirements.

C. B4B Accounts
Registration
You may view some Content on the Site without registering, but as a condition of using certain aspects of the Service, you may be required to register with B4B and select a screen name ("User ID") and password. You shall provide accurate, complete, and updated registration information. Failure to do so shall constitute a breach of the Terms of Use, which may result in immediate termination of your account. You shall not use as a User ID, domain name, or any name or term that (i) is the name of another person, with the intent to impersonate that person; (ii) is subject to any rights of another person, without appropriate authorization; or (iii) is offensive, vulgar, or obscene. B4B reserves the right in its sole discretion to refuse registration of or cancel a User ID, domain name, and username. You are solely responsible for activity that occurs on your account and shall be responsible for maintaining the confidentiality of your password for the Service.

Your B4B account gives you access to the services and functionality that we may establish and maintain from time to time and in our sole discretion. If you open a B4B account on behalf of a company, organization, or other entity, then (a) “you” includes you and that entity, and (b) you represent and warrant that you are an authorized representative of the entity with the authority to bind the entity to this Agreement, and that you agree to this Agreement on the entity’s behalf. By connecting to B4B with a thirdparty service, you give us permission to access and use your information from that service as permitted by that service, and to store your login credentials for that service.

You may never use another User’s account without permission. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. We encourage you to use “strong” passwords (passwords that use a combination of upper and lower case letters, numbers and symbols) with your account. You must notify B4B immediately of any breach of security or unauthorized use of your account. B4B will not be liable for any losses caused by any unauthorized use of your account.

You may control your User profile and how you interact with the Service by changing the settings in your Preferences. By providing B4B your email address you consent to our using the email address to send you Service-related notices, including any notices required by law, in lieu of communication by postal mail. We may also use your email address to send you other messages, such as changes to features of the Service and special offers. If you do not want to receive such email messages, you may opt out or change your preferences in "My Profile" under "User Preferences." There you will find a drop down menu where you can choose how often you receive emails from us. Opting out may prevent you from receiving email messages regarding updates, improvements, or offers.

D. Service Rules
You agree not to engage in any of the following prohibited activities: (i) transmitting spam, chain letters, or other unsolicited email; (ii) attempting to interfere with or compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service; (iii) taking any action that imposes, or may impose at our sole discretion an unreasonable or disproportionately large load on our infrastructure; (iv) uploading invalid data, viruses, worms, or other software agents through the Service; (v) collecting or harvesting any personally identifiable information, including account names, from the Service; (vii) impersonating another person or otherwise misrepresenting your affiliation with a person or entity, constituting fraud; (viii) interfering with the proper working of the Service; (ix) accessing any content on the Service through any technology or means other than those provided or authorized by the Service; or (x) bypassing the measures we may use to prevent or restrict access to the Service, including, without limitation, features that prevent or restrict use or copying of any content or enforce limitations on use of the Service or the content therein.

You shall not directly or indirectly: (i) decipher, decompile, disassemble, reverse engineer, or otherwise attempt to derive any source code or underlying ideas or algorithms of any part of the Service, except to the extent applicable laws specifically prohibit such restriction; (ii) modify, translate, or otherwise create derivative works of any part of the Service; or (iii) copy, rent, lease, distribute, or otherwise transfer any of the rights that you receive hereunder. You shall abide by all applicable local, state, national, and international laws and regulations.

If you operate a search engine or robot, or if you republish B4B Content (as we may determine in our reasonable discretion), you must follow these rules:
  • You must use a descriptive user agent header;
  • You must provide prominent attribution to B4B;
  • You must follow robots.txt at all times; and
  • You must make it clear how to contact you, either in your user agent string, or on your website if you have one.
We may, without prior notice, change the Service; stop providing the Service or features of the Service, to you or to Users generally; or create usage limits for the Service. We may permanently or temporarily terminate or suspend your access to the Service without notice or liability for any reason, including, if, in our sole determination, you violate any provision of this Agreement, or for no reason. Upon termination for any reason or no reason, you continue to be bound by this Agreement.

You are solely responsible for your interactions with other B4B Users. We reserve the right, but have no obligation, to monitor disputes between you and other Users. B4B shall have no liability for your interactions with other Users, or for any User’s action or inaction.

Trusted Users

B4B may provide certain Users with administrative privileges in order to monitor or provide certain aspects of the Service (“Trusted Users”). These privileges may include, without limitation, the ability to remove User Content provided by other Users or monitor other Users’ use of the Service. For the avoidance of doubt, B4B Trusted Users include, but are not limited to, “Admins” (aka SysOps or Administrators), Managers, including Forum Administrators, and Info.” You acknowledge that B4B may revoke your status as a Trusted User at any time for any reason or no reason, and may require you to enter into further agreements with B4B depending on your role.

If you are a Trusted User, you acknowledge that you may have access to the personal information of other Users, and you represent and warrant that you will handle that information in accordance with the B4B Privacy Policy and the confidentiality obligations contained herein. You further acknowledge that you may have access to B4B Confidential Information (as defined below), and you represent and warrant, at all times you are serving as a Trusted User and thereafter, to hold in strictest confidence, and not to use, except for the benefit of B4B to the extent necessary to perform authorized services on behalf of B4B, and not to disclose to any person, firm, corporation or other entity, without written authorization from B4B in each instance, any B4B Confidential Information that you obtain from B4B or otherwise obtain, access or create in connection with, or as a result of, your relationship with B4B or your performance of any services as a Trusted User, until such B4B Confidential Information becomes publicly and widely known and made generally available through no wrongful act of you or of others who were under confidentiality obligations as to the item or items involved. You further agree not to make copies of such B4B Confidential Information, except as expressly authorized by B4B and to return to B4B or delete any copies or materials containing B4B Confidential Information upon B4B’s request.

You understand that “B4B Confidential Information” means information and physical material not generally known or available outside B4B and information and physical material entrusted to B4B in confidence by third parties. B4B Confidential Information includes, without limitation: technical data, analytic data, User Internet Protocol (IP) addresses, any personal information relating to Users, software codes and designs, algorithms, non-public business information, and any other non-public information to which you gain access while serving as a Trusted User.

User Content

The Service allows Users to post content such as profile information, instructional and informational materials, photographs, images, comments, questions, and other content or information (any such materials a User submits, posts, displays, or otherwise makes available on the Service “User Content”). We claim no ownership rights over User Content created by you. The User Content you create remains yours; however, by sharing User Content through the Service, you agree to allow others to view, edit, and/or share your User Content in accordance with this Agreement (see “User Content License Grants” below). B4B has the right (but not the obligation) in its sole discretion to remove any User Content that is shared via the Service.

You agree not to post User Content that: (i) may create a risk of harm, loss, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to you or to any other person; (ii) may create a risk of any other loss or damage to any person or property; (iii) seeks to harm or exploit children by exposing them to inappropriate content, asking for personally identifiable details or otherwise; (iv) may constitute or contribute to a crime or tort; (v) contains any information or content that we deem to be unlawful, harmful, abusive, racially or ethnically offensive, defamatory, infringing, invasive of personal privacy or publicity rights, harassing, humiliating to other people (publicly or otherwise), libelous, threatening, profane, obscene, or otherwise objectionable; (vi) contains any information or content that is illegal (including, without limitation, the disclosure of insider information under securities law or of another party’s trade secrets); (vii) contains any information or content that you do not have a right to make available under any law or under contractual or fiduciary relationships; or (viii) contains any information or content that you know is not correct and current; or constitutes unsolicited or unauthorized advertising or promotional material or any junk mail, spam, or chain letters; contains software viruses or any other computer codes, files, or programs that are designed or intended to disrupt, damage, limit, or interfere with the proper function of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any system, data, password, or other information of the Company or any third party; is made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence; or impersonates any person or entity, including any employee or representative of B4B.

You agree that any User Content that you post does not and will not violate thirdparty rights of any kind, including without limitation any Intellectual Property Rights (as defined below) or rights of privacy. B4B reserves the right, but is not obligated, to reject and/or remove any User Content that B4B believes, by its sole discretion, violates these provisions or is otherwise inappropriate for the Service. You understand that publishing your User Content on the Service is not a substitute for registering it with the U.S. Copyright Office, the Writer’s Guild of America, or any other rights organization.

For the purposes of this Agreement, “Intellectual Property Rights” means all patent rights, copyright rights, mask work rights, moral rights, rights of publicity, trademark, trade dress and service mark rights, goodwill, trade secret rights and other intellectual property rights as may now exist or hereafter come into existence, and all applications therefore and registrations, renewals and extensions thereof, under the laws of any state, country, territory, or other jurisdiction.

In connection with your User Content, you affirm, represent and warrant the following:
  • A. You have the written consent of each and every identifiable natural person in the User Content to use such person’s name or likeness in the manner contemplated by the Service and this Agreement, and each such person has released you from any liability that may arise in relation to such use.
  • B. Your User Content and B4B’s use thereof as contemplated by this Agreement and the Service will not violate any law or infringe any rights of any third party, including but not limited to any Intellectual Property Rights and privacy rights.
  • C. B4B may exercise the rights to your User Content granted under this Agreement without liability for payment of any guild fees, residuals, payments, fees, or royalties payable under any collective bargaining agreement or otherwise.
  • D. To the best of your knowledge, all of your User Content and other information that you provide to us is truthful and accurate.
B4B takes no responsibility and assumes no liability for any User Content that you or any other User or third party posts or sends over the Service. You shall be solely responsible for your User Content and the consequences of posting or publishing it, and you agree that we are only acting as a passive conduit for your online distribution and publication of your User Content. You understand and agree that you may be exposed to User Content that is inaccurate, objectionable, inappropriate, or otherwise unsuited to your purpose, and you agree that B4B shall not be liable for any damages you allege to incur as a result of User Content.

Our Proprietary Rights

Except for your User Content, any User contributed article text, or as expressly provided herein, the Service and all materials therein or transferred thereby, including, without limitation, software, images, graphics, illustrations, text, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and User Content belonging to other Users (the “B4B Content”), and all Intellectual Property Rights related thereto, are the exclusive property of B4B and its licensors (including other Users who post User Content to the Service). Except as explicitly provided herein, nothing in this Agreement shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works from any B4B Content. Use of the B4B Content for any purpose not expressly permitted by this Agreement is strictly prohibited.


You may choose to, or we may invite you to, submit comments or ideas about the Service, including, without limitation, how to improve the Service or our products (“Ideas”). By submitting any Idea, you agree that your disclosure is gratuitous, unsolicited and without restriction and will not place B4B under any fiduciary or other obligation, and that we are free to use the Idea without any additional compensation to you, and/or to disclose the Idea on a non-confidential basis or otherwise to anyone. You further acknowledge that, by acceptance of your submission, B4B does not waive any rights to use similar or related ideas previously known to B4B, or developed by its employees, or obtained from sources other than you.

B4B Property

Certain aspects of the Service may allow you to obtain certain reputational or status indicators (“B4B Property”). You understand and agree that regardless of terminology used, B4B Property represents a limited license right governed solely by the terms of this Agreement and available for distribution at B4B’s sole discretion. B4B Property is not redeemable for any sum of money or monetary value from B4B at any time. You acknowledge that you do not own the account you use to access the Service, nor do you possess any rights of access or rights to data stored by or on behalf of B4B on B4B servers, including without limitation any data representing or embodying any or all of your B4B Property. You agree that B4B has the absolute right to manage, regulate, control, modify and/or eliminate B4B Property as it sees fit by its sole discretion, in any general or specific case, and that B4B will have no liability to you based on its exercise of such right. All data on B4B’s servers are subject to deletion, alteration, or transfer.

Governing Laws and Arbitration

Jurisdiction:

Arbitration:
For any dispute with B4B, you agree to first contact us at cm@b4blessing.com and attempt to resolve the dispute with us informally. In the unlikely event that B4B has not been able to resolve a dispute it has with you after attempting to do so informally, we each agree to resolve any claim, dispute, or controversy arising out of or in connection with or relating to this Agreement, or the breach or alleged breach thereof (collectively, “Claims”), by binding arbitration by the American Arbitration Association (“AAA”) under the Commercial Arbitration Rules and Supplementary Procedures for Consumer Related Disputes then in effect for the AAA, except as provided herein. The arbitration will be conducted in California, United States unless you and B4B agree otherwise. Each party will be responsible for paying any AAA filing, administrative and arbitrator fees in accordance with AAA rules. The award rendered by the arbitrator shall include costs of arbitration, reasonable attorneys’ fees and reasonable costs for expert and other witnesses, and any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. Nothing in this Section shall prevent either party from seeking injunctive or other equitable relief from the courts as necessary to prevent the actual or threatened infringement, misappropriation, or violation of that party’s data security, Intellectual Property Rights, or other proprietary rights. ALL CLAIMS MUST BE BROUGHT IN THE PARTIES’ INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING, AND, UNLESS WE AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS. General

A. Assignment
This Agreement, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by B4B without restriction. Any attempted transfer or assignment in violation hereof shall be null and void.

B. Notification Procedures and Changes to the Agreement
B4B may provide notifications, whether such notifications are required by law or are for marketing or other business related purposes, to you via email notice, written or hard copy notice, or through posting of such notice on our website, as determined by B4B at our sole discretion. B4B reserves the right to determine the form and means of providing notifications to our Users, provided that you may opt out of certain means of notification as described in this Agreement. B4B is not responsible for any automatic filtering you or your network provider may apply to email notifications we send to the email address you provide us. B4B may, at its sole discretion, modify or update this Agreement from time to time, and so you should review this page periodically. When we change the Agreement in a material manner, we will update the "last modified" date on this page. Your continued use of the Service after any such change constitutes your acceptance of the new Terms of Use. If you do not agree to any of these terms or any future Terms of Use, do not use or access (or continue to access) the Service.

C. Entire Agreement/Severability
This Agreement, together with any amendments and any additional agreements you may enter into with B4B in connection with the Service, shall constitute the entire agreement between you and B4B concerning the Service. If any provision of this Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect.

D. No Waiver
No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term, and B4B’s failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision.
